HOLIDAY, CAMP & BOOKING INFORMATION

General Booking Terms & Conditions - these Terms and Conditions contain some exclusions and limitations of liability. If any part of the terms and conditions proves to be invalid or unenforceable, the rest of the terms and conditions will remain valid. Thiis agreement is governed by English law and any disputes will be dealt with by English courts.

RIGHT OF REFUSAL

We expressly reserve the right to prevent you from participating in any aspect of the holiday packages and/or Tourparty Freestyle & Freeride Camp if in the reasonable opinion of our staff you are either unsuited to participate or if you appear to be under the influence of drugs or alcohol. In such an event no refund or other compensation will be due.

FORCE MAJEURE

Force Majeure means unusual and unforeseeable circumstances beyond our control or the control of our suppliers, resulting in events that could not have been avoided even if all reasonable care had been taken. Such circumstances include (but are not limited to) war or threat of war, riot, civil strife, industrial dispute, unavoidable technical problems wiht transport, closure or congestion of airports and ports, terrorist activity, natural or nuclear disaster, fire and adverse weather conditions (including heavy / insufficient snow falls or non-freezing conditions).

COMPLAINTS

If you have a complaint you must inform us as soon as possible, preferably in writing. We will confirm receipt of your complaint, clarify it to confirm understanding, and do everything reasonable to settle the matter to your satisfaction and our own. If you do not inform us of your complaint immediately the problem occurs we may not be able to investigate and address it, in this case we reserve the right not to deal with it.

ONLINE BROCHURE ACCURACY

We try to ensure that all information given about the holiday packages and Camp are true and accurate however circumstances can change after publication. In the event of a change we will notify you as soon as possible.

PRICING

We have ensured our prices are as competitive as possible with the packages available from tour operators - the prices are about the same or better. (When comparing prices please ensure you are comparing like with like.)

We reserve the right to change holiday and/or Camp prices.

VALUE ADDED TAX (VAT)

Tourparty is part of Triple Air Ltd, VAT registration number: 725552925. VAT is included in the pricing where applicable. This has been calculated under the "Tour Operators Margins Scheme". 14 days after the holiday (provided payment has been received in full) a VAT receipt detailing VAT paid will be sent to you.

OUR RESPONSIBILITY

We accept responsibility for the proper performance of our obligations under our contract with you. We will perform such obligations with reasonable skill and care. We are not responsble for any failure that is:

  • attributable to you or a member of your party;
  • attributable to a third party unnconnected with the provision of the services to you, and is unforeseeable and unavoidable;
  • due to Force Majeure (see the section "Force Majeure").

CHANGES TO YOUR BOOKING

To make minor changes to a booking that do not involve the entire cancellation of the holiday (but may involve the change or cancellation of extras such as lift passes or Camp places) the person responsible for making the original booking must inform us as soon as possible, preferably in writing. We will make every effort to accomodate the change(s) requested. We regret we will not be able to process any requests for changes with less than 14 days notice prior to the holiday and/or Camp.

Where additional payment is required as a result of the changes we will invoice you on 14 day terms.

Where a refund is due as a result of a change or changes we will make the refund within 30 days.

CANCELLATION BY YOU

The deposit is refundable up to 1 December 2006. From the 2nd December the deposit and all other monies paid towards the holiday will be retained if the enitre holiday booking is cancelled by you. (We suggest you consider cancellation insurance if you think this is a possibility.)

However if the cancellation is made with more than 30 days notice where possible we will make every effort to transfer your booking to alternative dates in the 2006-2007 season, to suit you. If this is not possible (because of lack of availability on either side) then the monies paid less a service charge of £150 per person may be credited against a holiday taken by you or a third party nominated by you during the 2007-2008 season. (However if this option is not taken on or before 1 May 2008 then this offer will have expired and all monies will be forfeited, be retained in full without refund.)

CANCELLATION BY US

We aim to avoid making changes to your booking such as disruption or alteration to the holiday packages and/or Camp as described in good faith. However we reserve the right to amend or adjust any aspect of the holiday and Camp packages should we judge this necessary for us to meet the expectations of all our customers and our commitment to giving our customers the best possible holiday experience and value for money. No compensation will be offered for any minor changes made before or during the holiday.

In the event we have to make major changes to your holiday (such as the dates of the holiday packages and/or Camp being altered by more than 24 hours or that the packages and/or Camp are entirely cancelled), all customers affected will be offered the option of:

  • a full refund or
  • an alternative holiday and/or Camp of equivalent value and description.

In the event that the alternative holiday is priced differently, Tourparty will be responsible for paying the difference should the alternative holiday be more expensive, or will refund the difference if the alternative holiday is cheaper.

TERMINATION AND COMPENSATION

You and your party must behave reasonably while on holiday. We reserve the right, at our reasonable discretion, to terminate the holidays of people who indulge in serious misconduct. If we do so we will have no further responsibility or liability to you. If you or any member of your party wilfully, recklessly or negligently damages any accommodation, property or person, or causes delay to or diversion of any means of transport, you agree to compensate us for any loss we may suffer, including legal costs.

BOOKING CONFIRMATION

Our contract with you is made when you confirm your holiday booking by paying a deposit (per person) and submitting a completed booking form. If we accept it we will reserve your holiday and send you a confirmation invoice. Please check that the booking detailed on this invoice is correct. We reserve the right to refuse any booking. If we do this we will refund any money already paid to us.

PAYMENT TERMS & SCHEDULE

We are able to accept payment by credit or debit card, sterling cheque, bank draft or bank transfer (BACS).

However we appreciate that it is not easy making payment in full for a holiday at the time of booking so we are pleased to give you the opportunity to spread payments:

New Year bookings:

  • Please pay the full amount due.

For Easter bookings:

If the amount due is less than £350 please pay it in full.

if the amount due is more than £350 please pay according to the following payment schedule (or pay the full amount now if you prefer):

  • 50% now, with your booking form.
  • The remainder on 1 February 2007.

You can pay by credit card (online or offline), BACS, wire transfer or sterling cheque (please make all payments payable to "Tourparty").

On receipt of your booking form and payment we will confirm the booking, the outstanding balance and the payment schedule.

GROUPSKI BOOKINGS - APARTMENTS

When booking the "GroupSki" package parties must be in multiples of 4 or 6 people (or pay a supplement for under occupancy) and at least 1 person staying in the apartment must be 18 years old or over.

When booking you should specify what size apartment you require. We will need a deposit for 4 or 6 people with your booking form but you do not need to give the names of all the people staying in the apartment at this stage. (This is flexible, you can change the names up to two weeks before the holiday.)

Where possible we will be happy to change your apartment from a 4 to 6 person apartment if required, however it may be more difficult to change from a 6 to 4 person apartment.

Please note the maximum occupancy of each apartment is 4 or 6 people as stated. Over-occupancy would breach French fire regulations and the booking conditions, resulting in immediate cancellation of the booking with no compensation for refund for any member of the party and forteiture of the full deposit paid on arrival.

For families or friends booking more than one apartment we will try to ensure the apartments are as close to each other as possible.

The apartment will not normally be available earlier than 5pm on the day of arrival and should be vacated by 9am on the day of departure. (Special arrangements will be made to provide shower and changing facilities for those skiing on the seventh day.)

At least 1 person in the party must attend the Camp (open to anyone aged 10 to 70!).

GROUPSKI AND ADSKI BOOKINGS - APARTMENT DEPOSIT

A refundable cash deposit of 50 Euro per person must be paid on arrival by those on the GroupSki and AdSki packages. (Failure to present the deposit will mean cancellation of the apartment booking with no refund.)

You will be required to clean the apartment prior to departure. Cleaning must be of a standard suitable for the arrival of new guest. The apartment managers are very strict about ensuring apartments are left in the same condition as they are found… clean, tidy, with no breakages and nothing missing. Normally this is not a problem and deposits are returned in full at the end of the week. However if an apartment is not properly cleaned or items are damaged or missing then you should expect to have some or all of your deposit withheld.

TRANSPORT

Transport to and from the UK is not included unless specified.

Transport to and from Alpe d'Huez from Les Deux Alpes is included for all those booking accommodation and/or the Tourparty Freestyle & Freeride Camp with Tourparty.

INSURANCE

You cannot travel with us without suitable travel insurance. We will not be held liable for any loss or damage you experience because you do not hold sufficient insurance, nor will we be able to make any payments on your behalf for medical costs or other costs you may incur. In the event that we have to refund you for your holiday (due to major changes) we will not be liable for any additional expenses, including insurance fees.

Most standard winter holiday insurance packages cover all skiing on-piste (including freestyle skiing in the snow park) and also off-piste skiing in patrolled areas. You should not need to buy any special insurance cover for freestyle and freeride skiing. However please ensure that you have sufficient insurance to cover evacuation from the mountain by helicopter, all medical bills and other costs that may arise if you are in an accident, including transport/medi-vac back to the UK if you are seriously injured. You may also want cover for belongings lost, damaged or stolen and you may want to consider compensation incase you are prevent from working or studying on your return to the UK, or if you get some long-term disability.

Snowsports are by their nature a risky and potentially life-threatening activity. In coming on this holiday and/or participating in the Tourparty Camp you understand and accept this and neither you nor your family will not hold Tourparty or their staff or sponsors responsible for anything that may happen to you. We cannot be held responsible for something you enter into voluntarily knowing fully the risks involved!

TRAVEL ADVICE

PASSPORT

You will require a valid Passport for travel to France and depending on your nationality you may require a visa. Please ensure you have a valid Passport with you, and we suggest you bring a photocopy of it as well incase of loss or damage. If relevant please check on the Passport requirements for children who may or may not need their own Passport.

Those being travelling with us by Executive Coach from the UK will be required to show their Passport when boarding the bus. If you do not have a valid Passport (and visa if required) we will have no choice but to refuse to carry you on the bus as you will not be allowed through Passport Control on arrival at the port.

EUROPEAN EDHTU - European Health Insurance Card (EHIC)

UK residents are entitled to medical treatment at reduced cost or sometimes free when temporarily visiting a European Union (EU) country. This does not replace travel insurance.

To obtain treatment you will need to take a European Health Insurance Card (EHIC) with you, this replaces the old E111. Obviously your insurance should cover medical emergencies however other treatment for illness may be required in which case it would prove helpful to have the EHIC.
