BOOKING TERMS AND CONDITIONS


General Booking Terms & Conditions - these Terms and Conditions contain some exclusions and limitations of liability. If any part of the terms and conditions proves to be invalid or unenforceable, the rest of the terms and conditions will remain valid. This agreement is governed by English law and any disputes will be dealt with by English courts.

GENERAL TERMS

DIRTTRIBE, MUTRIBE, TOURPARTY & TRIBOOST

Your booking is with DirtTribe, MuTribe, Tourparty & TribBoost trading entities of Tourparty, part of Triple Air Ltd, registered as a limited company in England and Wales, VAT registration number: 725552925.

RIGHT OF REFUSAL

We expressly reserve the right to prevent you from participating in any aspect of the holiday packages and/or Camp if in the reasonable opinion of our staff you are either unsuited to participate or if you appear to be under the influence of drugs or alcohol. In such an event no refund or other compensation will be due.

FORCE MAJEURE

Force Majeure means unusual and unforeseeable circumstances beyond our control or the control of our suppliers, resulting in events that could not have been avoided even if all reasonable care had been taken. Such circumstances include (but are not limited to) war or threat of war, riot, civil strife, industrial dispute, unavoidable technical problems wiht transport, closure or congestion of airports and ports, terrorist activity, natural or nuclear disaster, fire and adverse weather conditions (including heavy / insufficient snow falls or non-freezing conditions).

COMPLAINTS

If you have a complaint you must inform us as soon as possible, preferably in writing. We will confirm receipt of your complaint, clarify it to confirm understanding, and do everything reasonable to settle the matter to your satisfaction and our own. If you do not inform us of your complaint immediately the problem occurs we may not be able to investigate and address it, in this case we reserve the right not to deal with it.

ONLINE BROCHURE ACCURACY

We try to ensure that all information given about the holiday packages and Camp are true and accurate however circumstances can change after publication. In the event of a change we will notify you as soon as possible.

PRICING

We have ensured our prices are as competitive as possible with the packages available from tour operators - the prices are about the same or better. Please remember if comparing our prices with other holiday operators to check carefully what is included and ensure you are comparing like with like - our full residential holiday and Camp package prices includes comfortable accommodation in en-suite rooms, all meals, lift pass, expert coaching and guiding (all day every day!), 24/7 care and supervision and off-snow activities programme for Youth participants, demo ski and snowboard testing, video feedback, photographs, prizes and awards and lots more...

We welcome bookings from all over the world. We require payment in GB Sterling and for this reason we charge credit and debit cards etc and request bank transfers and cheques (checks) in the GB Sterling price of the holiday. However to help international participants with pricing we have also given prices in EURO and US Dollars where possible (calculated according to the exchange rate on 10 September 07). These alternative currency prices are a guide only, the exchange rate may differ when you book.

We reserve the right to change holiday and/or Camp prices.

VALUE ADDED TAX (VAT)

DirtTribe, MuTribe, Tourparty & TriBoost are trading entities of Tourparty, part of Triple Air Ltd, VAT registration number: 725552925. VAT is included in the pricing where applicable. This has been calculated under the "Tour Operators Margins Scheme". 14 days after the holiday (provided payment has been received in full) a VAT receipt detailing VAT paid will be sent to you.

OUR RESPONSIBILITY

We accept responsibility for the proper performance of our obligations under our contract with you. We will perform such obligations with reasonable skill and care. We are not responsible for any failure that is:

  • attributable to you or a member of your party;
  • attributable to a third party unconnected with the provision of the services to you, and is unforeseeable and unavoidable;
  • due to Force Majeure (see the section "Force Majeure").

CHANGES TO YOUR BOOKING

To make minor changes to a booking that do not involve the entire cancellation of the holiday (but may involve the change or cancellation of extras such as lift passes or Camp places) the person responsible for making the original booking must inform us as soon as possible, preferably in writing. We will make every effort to accommodate the change(s) requested. We regret we will not be able to process any requests for changes with less than 14 days notice prior to the holiday and/or Camp.

Where additional payment is required as a result of the changes we will invoice you on 14 day terms.

Where a refund is due as a result of a change or changes we will make the refund within 30 days.

CANCELLATION BY YOU

Any cancellation request must be made in writing by fax or post, enclosing full details of the booking and specifying exactly the changes/cancellation you wish to make.

In the event of cancellation before 1 December 2007 for the February 2008 Half-term holidays/Camps, 1 February 2008 for the Easter holidays/Camps and 1 June 2008 for the Summer holidays/Camps, a full refund will be given.

In the event of cancellation after 1 December 2007 for the February 2008 Half-term holidays/Camps, 1 February 2008 for the Easter holidays/Camps and 1 June 2008 for the Summer holidays/Camps, we will retain £250 (360 EUR, $500 USD) of the booking fee per person to cover administration and cancellation costs. The remainder of the booking fee will be refunded in full.

Unfortunately, regardless of the circumstances, we can only make a 25% refund in the event that you cancel within 14 days of the first day of the holiday/Camp (we have to retain the remainder to cover our costs).

We recommend you consider taking Cancellaton Insurance if you think there is any risk of cancellation, especially if you think there is any risk of cancellation within 14 days of your date of departure.

CANCELLATION BY US

We aim to avoid making changes to your booking such as disruption or alteration to the holiday packages and/or Camp as described in good faith. However we reserve the right to amend or adjust any aspect of the holiday and Camp packages should we judge this necessary for us to meet the expectations of all our customers and our commitment to giving our customers the best possible holiday experience and value for money. No compensation will be offered for any minor changes made before or during the holiday.

In the event we have to make major changes to your holiday (such as the dates of the holiday packages and/or Camp being altered by more than 24 hours or that the packages and/or Camp are entirely canceled), all customers affected will be offered the option of:

  • a full refund or
  • an alternative holiday and/or Camp of equivalent value and description.

In the event that the alternative holiday is priced differentl we will be responsible for paying the difference should the alternative holiday be more expensive, or will refund the difference if the alternative holiday is cheaper.

We cannot be held responsible for any costs incurred in the event of cancellation and recommend you take travel insurance.

TERMINATION AND COMPENSATION

You and your party must behave reasonably while on holiday. We reserve the right, at our reasonable discretion, to terminate the holidays of people who indulge in serious misconduct. If we do so we will have no further responsibility or liability to you. If you or any member of your party wilfully, recklessly or negligently damages any accommodation, property or person, or causes delay to or diversion of any means of transport, you agree to compensate us for any loss we may suffer, including legal costs.

BOOKING CONFIRMATION

Our contract with you is made when you confirm your holiday booking and submit a completed booking form. If we accept it we will reserve your holiday and send you a confirmation invoice. Please check that the booking detailed on this invoice is correct. We reserve the right to refuse any booking. If we do this we will refund any money already paid to us.

Full details of the holiday/Camp will be sent to all participants on or before 1 January 2007 for the February 2008 Half-term holidays/Camps, 1 March 2008 for the Easter holidays/Camps and 1 July 2007 for the Summer holidays/Camp. As much as possible, this will include a confirmed, detailed itinery, full details on all accommodation and transportation arrangements, information on the Coaching team and guidelines on what to bring etc.

TRANSPORT

Transport to and from the UK and transfers to and from the airport(s) are not included unless specified and/or specifically booked and paid for.

INSURANCE

You cannot travel with us without suitable travel insurance. We will not be held liable for any loss or damage you experience because you do not hold sufficient insurance, nor will we be able to make any payments on your behalf for medical costs or other costs you may incur. In the event that we have to refund you for your holiday (due to major changes) we will not be liable for any additional expenses, including insurance fees.

If you are skiing or snowboarding... most standard winter holiday insurance packages cover all skiing on-piste (including freestyle skiing in the snow park) and also off-piste skiing in patrolled areas. You should not need to buy any special insurance cover for ski cross, freestyle and freeride skiing. However please ensure that you have sufficient insurance to cover evacuation from the mountain by helicopter, all medical bills and other costs that may arise if you are in an accident, including transport/medi-vac home if you are seriously injured. You may also want cover for belongings lost, damaged or stolen and you may want to consider compensation in case you are prevent from working or studying on your return to the UK, or in the event of long-term disability or death.

Mountain Biking, Multi-Activities, Snowsports & Triathlon are by their nature risky and potentially life-threatening activities. In coming on this holiday and/or participating in the DirtTribe, MuTribe, Tourparty & TriBoost Camps you understand and accept this and neither you nor your family will not hold Tourparty (Triple Air Ltd) or their staff or sponsors responsible for anything that may happen to you. We cannot be held responsible for something you enter into voluntarily knowing fully the risks involved!

TRAVEL ADVICE

PASSPORT

You will require a valid Passport for travel to France or Switzerland and depending on your nationality you may require a visa. Please ensure you have a valid Passport with you, and we suggest you bring a photocopy of it as well in-case of loss or damage. If relevant please check on the Passport requirements for children who may or may not need their own Passport.

If you require advice on Passports please contact your national Passport service (in the UK the Passport Adviceline is available on 0870 521 0410).

EUROPEAN EDHTU - European Health Insurance Card (EHIC)

EU residents are normally entitled to medical treatment at reduced cost or sometimes free when temporarily visiting a European Union (EU) country. This does not replace travel insurance.

To obtain treatment under this scheme you will need to have some proof of residency and qualification for your own national health service. For UK residents this means taking a European Health Insurance Card (EHIC) with you, this replaces the old E111. Obviously your insurance should cover medical emergencies however other treatment for illness may be required in which case it would prove helpful to have the EHIC.

If you are resident in the UK you can apply for an EHIC, free of charge, by calling 0845 606 2030, picking up an application form from the Post Office or going to the website:

ADDITTIONAL COMMENTS

  • DirtTribe, MuTribe, Tourparty & TriBoost holidays and Camps are open to people of all ages (with different packages for adults aged 18+ years and youth aged 10 years to 17 years) from any country.

  • No participants under 18 years may purchase or consume alcohol, drugs or tobacco at any time (unless aged 16 years or over where it is within the laws of the country and written permission has been given by a parent or guardian). Anyone under 18 years on a DirtTribe, MuTribe, Tourparty & TriBoost Camp found to be breaking these terms will be sent home at their own expense, without refund.

  • Parents, family and friends of young people attending a Holiday or Camp are welcome to join us in resort, where possible we will include you in the programme and/or advise on activities and excursions you can do. For information on accommodation in the resort please refer to the holiday and Camp information pages.

  • We regret we cannot reserve places without a completed booking form and deposit/payment as we are reserving accommodation etc for each booking.

  • Places are strictly limited and will be allocated on a first come, first served basis. We cannot accept any more participants once these places have been fully allocated.
